Terms of Service

Welcome to FlashMCP. These Terms of Service ("Terms") govern your access to and use of FlashMCP's services, website, and API gateway (collectively, the "Service"). By using FlashMCP, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Description of Service

FlashMCP is a hosted MCP (Model Context Protocol) gateway that transforms REST APIs with OpenAPI specifications into MCP-compatible servers. The Service includes:

  • An API gateway that proxies MCP requests to upstream APIs
  • Automatic OpenAPI specification discovery and parsing
  • A web-based dashboard for managing API keys and monitoring usage
  • A prepaid credit system for billing

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Keep your password and API keys secure and confidential
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 16 years old to create an account. By registering, you represent that you meet this age requirement.

4. API Keys and Authentication

API keys are issued for your use only. You may not share, sell, or transfer your API keys to third parties. You are responsible for all usage associated with your API keys. If you suspect unauthorized use, you should revoke the key immediately via the dashboard and contact us.

5. Prepaid Credits and Billing

The Service uses a prepaid credit system. You purchase credits in advance, and each API request consumes one credit. Key billing terms:

  • Credits are purchased in fixed tiers via Stripe Checkout
  • Credits do not expire
  • Credits are non-refundable except as required by applicable law
  • When your credit balance reaches zero, API requests will be rejected until you add more credits
  • Pricing is subject to change with 30 days' notice

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Access APIs without proper authorization from the API provider
  • Transmit malware, viruses, or other harmful code
  • Attempt to probe, scan, or test the vulnerability of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service
  • Use the Service to send spam, phishing, or other unsolicited communications
  • Resell or redistribute the Service without prior written consent

7. Upstream API Responsibility

FlashMCP acts as a gateway between your MCP client and upstream APIs. You are responsible for:

  • Compliance with the terms of service of any upstream APIs you access through FlashMCP
  • Obtaining and maintaining valid authentication credentials for upstream APIs
  • The content and nature of all requests and data transmitted through the Service

FlashMCP does not store request or response bodies. We do not control the availability, accuracy, or content of upstream APIs.

8. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

9. Intellectual Property

The Service, including its design, code, and documentation, is owned by FlashMCP and protected by intellectual property laws. You retain ownership of any data you transmit through the Service. We claim no intellectual property rights over the content of your API requests and responses.

10. Limitation of Liability

To the maximum extent permitted by law, FlashMCP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to FlashMCP in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service will immediately cease
  • All API keys associated with your account will be revoked
  • Unused credits are non-refundable unless required by applicable law

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, providing additional notice (such as email notification). Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules.
